Super Fan ‘Hot Take’ (“the Competition”) Terms & Conditions

  2. New Zealand Rugby Commercial LP, a limited partnership registered in New Zealand, acting through its General Partner, New Zealand Rugby Commercial GP Limited, 100 Molesworth Street, Thorndon, Wellington 6011, is the promoter of this Competition (“the Promoter”).
  3. This Competition is not in any way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or Twitter. Any queries, comments or complaints about the Competition must be directed to the Promoter and not to Facebook, Instagram or Twitter. In participating in the Competition, you are providing information to the Promoter and not to Facebook, Instagram or Twitter. To the extent permitted by law, you agree to release Facebook, Instagram and Twitter from any and all claims and demands arising out of or in connection with your participation in the Competition or with any of the prizes offered.
  4. The Competition is open to worldwide to entrants of any age. Entrants must not be resident in a jurisdiction in which participation breaches any applicable laws. By entering, the entrant warrants that he or she is permitted by law in the relevant jurisdiction to do so. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
  5. Employees of the Promoter and New Zealand Rugby Union Incorporated (“NZR”) as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible to enter the Competition.
  6. The winner of the Competition agrees to the Promoter sharing their entry through the Promoter’s website https://www.superrugby.co.nz/hot-take-terms-and-conditions/ and social media channels of the Promoter, announcing them as the winner, including their full name for no compensation.

Competition Entry

  1. To enter the Competition, you must email [email protected] with your entry which must include:
    1. your name and favourite Super Rugby Pacific team, and
    2. in 100 words or less (excluding your name and favourite team), your ‘hot take’ from the relevant Super Rugby Pacific round.
  2. Upon entering the Competition, you grant the Promoter a non-exclusive, non-revocable, royalty-free, worldwide licence to use, reproduce, publish and display your entry in any media or distribution method, including publication on websites and internet applications without restriction and without making any payment to you, for the purpose of promotion of the Competition and Super Rugby Pacific as the Promoter sees fit. Such use will be at the Promoter’s discretion and the Promoter is not obligated to use, reproduce, publish or display your submission.
  3. You may enter the Competition multiple times during the Competition Periods but each entry should be substantially different to any of your previous entries.
  4. Details of the Competition, including details of the entry process will be communicated via the Super Rugby New Zealand’s Facebook page https://www.facebook.com/superrugbynz/, Instagram page https://www.instagram.com/superrugbynz/ and twitter page https://twitter.com/superrugbynz, and on the Super Rugby New Zealand website https://www.superrugby.co.nz/hot-take-terms-and-conditions/.
  5. The Promoter reserves the right to remove, have removed or disqualify any entry that does not meet these terms and conditions at any time without notice.

Your Content

  1. Your entry must:
    1. not include any objectionable material; and
    2. be fit for public display, and not be content that may be offensive to the public or that may damage the reputation of the Promoter (as determined in the Promoter's sole discretion).
  2. The Promoter reserves the right to remove or disqualify any entry that does not meet the above conditions at any time without notice.
  3. You warrant that the entry does not infringe on the moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim or interest in the entry. You fully indemnify the Promoter against any claims arising from the display or use of your entry.

Competition Periods

  1. The Competition Periods for each Super Rugby Pacific round are as follows:
    1. Super Rugby Pacific Round 12 Competition Period: commences Friday, 12 May 2023 at 10:00am (NZT)] and closes Sunday, 14 May 2023 at 11:59pm (NZT).
    2. Super Rugby Pacific Round 13 Competition Period: commences Friday, 19 May 2023 at 10:00am (NZT)] and closes Sunday, 21 May 2023 at 11:59pm (NZT).
    3. Super Rugby Pacific Round 14 Competition Period: commences Friday, 26 May 2023 at 10:00am (NZT)] and closes Sunday, 28 May 2023 at 11:59pm (NZT).
    4. Super Rugby Pacific Round 15 Competition Period: commences Friday, 2 June 2023 at 10:00am (NZT)] and closes Sunday, 4 June 2023 at 11:59pm (NZT). (“Competition Periods”)The Prize(s)
  2. The Competition prizes available consist of:
    1. Super Rugby Pacific Round 12 Competition Prize: two tickets to any Super Rugby Pacific round 13 match being in played New Zealand NZD $100.00.
    2. Super Rugby Pacific Round 13 Competition Prize: two tickets to any Super Rugby Pacific round 14 match being in played New Zealand NZD $100.00.
    3. Super Rugby Pacific Round 14 Competition Prize: two tickets to any Super Rugby Pacific round 15 match being in played New Zealand NZD $100.00.
    4. Super Rugby Pacific Round 15 Competition Prize: two tickets to any Super Rugby Pacific quarter finals match being in played New Zealand, valued at approximately NZD $100.00.
  3. All prize winners will be chosen by the Promoter in accordance with set judgment criteria. Winning entries will be judged on passion, originality, appropriateness for public audience, and effort.
  4. The Promoter reserves the right to disqualify any winner who does not comply with these terms and conditions and select a replacement winner in accordance with these terms and conditions.
  5. Once determined, the Prize winner(s) will be notified directly via email within one (1) day of the applicable Competition Period and announced as via the Super Rugby New Zealand Facebook, Instagran and Twitter pages and the Super Rugby New Zealand website.
  6. The right to receive any prize is conditional upon the winner contacting the Promoter within three (3) days of being notified and confirming which New Zealand Super Rugby Pacific match tickets the winner would like to receive.
  7. Where the winner contacts the Promoter and claims the prize in accordance with clause 20, they will be responsible for complying with the ticketing terms and conditions for the Prize.
  8. If the winner cannot be contacted or does not claim the prize as stated in clause 20, the Promoter reserves the right to withdraw the prize from the winner.
  9. The prizes only include items as stated in clause 16. The Promoter is not responsible for the payment of any duties, fees or taxes, or any other expenses incurred in taking up the prizes. Unless expressly stated in these terms and conditions, all other expenses are the responsibility of the prize winner, including but not limited to cost of travel, insurance including travel insurance, meals, accommodation, optional activities or excursions and all other ancillary costs. The prize cannot be converted into cash. The prize is non-transferable and non-exchangeable.

Privacy

  1. Any personal information relating to the winner or any other entrants provided in Competition entries are collected by the Promoter solely for the purposes of this Competition, will be used solely in accordance with the Privacy Act 2020 and will not be disclosed to a third party without the entrant’s prior consent. You can contact us at any time regarding your personal information through our Privacy Officer who can be contacted via post (Privacy Officer, New Zealand Rugby Commercial LP, 100 Molesworth Street, Thorndon, Wellington 6011) or email ([email protected]).
  2. The Promoter's decisions in respect of all matters to do with the Competition are final and no correspondence will be entered into.
  3. The Promoter reserves the right to substitute any prize in whole (or any of its components), with a substitute prize of equal or greater value if the prize (or any of its components) cannot be provided for reasons outside the Promoter's reasonable control.
  4. To the fullest extent permitted by law, the Promoter gives no representation, guarantee or warranty with respect to the prize provided under this Competition. In particular, the Promoter gives no warranty with respect to the quality of the Prize, its suitability or fitness for any purpose.
  5. The winner takes the Prize entirely at his/her own risk and indemnifies the Promoter and any third party provider engaged for the purposes of this Competition in respect of any claim, demands, actions, losses, liabilities and suits arising out of or attributable to participation in the Competition and/or any use of the Prize.
  6. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries into the Competition. Entries are deemed to be received at the time of receipt of the entry via email to [email protected]. The Promoter assumes no responsibility for any injury or damage to entrant's or any other person’s electronic devices related to or resulting from participation in or downloading any materials in relation to the Competition. The Promoter reserves the right to disqualify any entrant who tampers with any of the Competition processes or engages in conduct that may damage the reputation of the Promoter or its affiliated entities at any time.
  7. To the fullest extent permitted by law, neither the Promoter nor any other person or party associated with the Competition shall be liable for any loss or damage whatsoever suffered (including but not limited to indirect or consequential loss) or personal injury suffered or sustained in connection with either participation in the Competition or with any prizes offered.
  8. This Competition and these terms and conditions will be governed by the laws of New Zealand and any disputes will be subject to the exclusive jurisdiction of the Courts of New Zealand.
  9. Nothing in these terms and conditions limits or modifies the consumer's rights under the Consumer Guarantees Act 1993.
  10. If for any reason beyond its reasonable control the Promoter or its agents or contractors are unable to run the Competition as described, the Promoter reserves the right to postpone, extend, amend, re-schedule or cancel the Competition (“the Change”) at any time at its sole discretion on the provision of reasonable notice (which will include posting notice of the Change on the Super Rugby New Zealand Facebook, Instagram and Twitter pages, and the Super Rugby New Zealand website).
  11. The Promoter reserves the right to alter, amend or supplement these terms and conditions at any time in its absolute discretion. You agree that you shall be bound by such changes and that you shall not hold the Promoter liable for any losses resulting from any such changes.
